Announcement of a competition for 560 vacant positions of judges in local courts

1. The Competition for 560 vacant positions of judges in local courts (hereinafter referred to as the Competition) is held in conformity with the Law of Ukraine “On the Judiciary and the Status of Judges”, Regulations on holding a competition to fill a vacant position of a judge, vacancy pools for local court judges, and decisions of the Commission.

The current Regulation on holding a competition to fill a vacant position of a judge is available on the Commission’s official website, the “Activities” section, “Competition for the position of a judge” subsection.

The current vacancy pools for local court judges and candidates for local court judges can be found in the section “Vacancy Pool for Judges” of the subsection “Recruitment of Judges” of the section “Activities” of the official website of the Commission.

  1. The deadline for documents submission to participate in the Competition is until 16 October 2023 (inclusive).

An extract from the Register of State Certificates on the level of Ukrainian language proficiency can be submitted until 24 November 2023.

  1. The procedure for submitting documents to participate in the Competition.

       4.1. Documents are to be in a paper form.

       4.2. Sending of the documents is made by registered mail with a notification and the possibility of tracking the completed transactions via the “Internet” network (date of sending, passing and receipt of the letter).

       4.3. Address for receiving documents is 9, General Shapoval Street, Kyiv, 03110.

 

  1. To participate in the Competition, a candidate for the position of a judge, not being in military service at the time of documents submission, must provide an application in accordance with Appendix 1 to this announcement, along with the following documents:
  1. a description of the application attachments for participation in the competition in accordance with Appendix 2 to this announcement;
  2. a copy of the passport of a citizen of Ukraine;
  3. an application form of a candidate for the position of a judge in accordance with Appendix 4 to the Regulation on conducting a competition for the vacant position of a judge;
  4. declaration of family ties of the candidate for the position of judge;
  5. declaration of integrity of the candidate for the position of judge;
  6. a copy of the work book, track record (if available) and other documents confirming the length of professional activity in the field of law (if available);
  7. a certificate of passing preliminary, periodic and extraordinary psychiatric examinations in the form of primary accounting documentation № 100-2/о;
  8. a declaration copy of the person authorized to perform the state or local self-government functions for 2022;
  9. a copy of a military ticket or a document that replaces it (for military liable);
  10. an extract from the Register of State Certificates or a copy of the State Certificate issued by the National Commission on the Standards of the State Language on proficiency in the State language at the level of first or second degree;
  11. criminal record (from the information and analytical system “Accounting of information about bringing the person to criminal responsibility and the presence of the criminal record”);
  12. a document confirming any change of the candidate’s full name in case of their inconsistency with the data mentioned in the candidates reserve for the position of judge;
  13. electronic medium with scanned copies of the documents mentioned in this announcement certified by a qualified electronic signature.

The documents (materials) specified in subparagraphs 2-13 of paragraph 5 of this announcement must meet the requirements of subparagraphs 3.5.1 and 3.5.2 of paragraphs 3.5 of the Regulation conducting a competition to fill a vacant judicial office and are formalized in the form of a numbered appendix to the application.

  1. To participate in the Competition, a candidate for the position of a judge, being in military service at the time of documents submission, , must provide an application in accordance with Appendix 1 to this announcement, along with the following documents:
  1. a copy of the passport of a citizen of Ukraine;
  2. copies of documents confirming the fact of military service;
  3. a document confirming any change of the candidate’s full name in case of their inconsistensy with the data mentioned in the candidates reserve for the position of judge (if available).
  1.  Stages of the Competition:
  1. formation of a rating of competition participants for the positions of judges of local administrative courts;
  2. formation of a rating of competition participants for the positions of judges of local commercial courts;
  3. formation of a rating of competition participants for the positions of judges of local general courts.
  1. The venue of the Competition is the High Qualification Commission of Judges of Ukraine (Kyiv, General Shapoval Street, 9).
  2. Date and time of the Competition:
    9.1. Formation of the rating of competition participants for the positions of judges of local administrative courts:

date – 01 December 2023;

start of candidate registration – 01:00 p.m.;

beginning of the competition – 01:30 p.m.;

backup dates – 02 and 03 December 2023;

  1. 9.2. Formation of the rating of competition participants for the positions of judges of local commercial courts:

date – 08 December 2023;

start of candidate registration – 01:00 p.m.;

  1. backup dates: 16 December 2023 is for persons admitted to the ranking of competition participants for the positions of judges of local general courts on 15 December 2023; 17, 22–24 December 2023 are for all persons admitted to the ranking of competition participants for the positions of judges of local general courts.

    9.4. Backup dates of the Competition may be used in connection with extraordinary circumstances (announcement of the “Air raid alert” in the city of Kyiv, absence of electricity, etc.) or if no winners have been identified during the main date of the competition for all vacant positions of judges, in respect of which the corresponding stage of the Competition was held.

    9.5. Information on changing the date and time of the Competition stages, as well as the use of backup dates, will be published on the official website immediately after its determination.
  2. Terms of the Competition.
    10.1. The participation is allowed for those who:
    1. submitted all necessary documents in the manner and within the time limits specified in the announcement;
    2. being in the reserve for filling vacant positions of judges of local courts on the day of documents submission, do not hold a judicial position and meet the requirements for candidates for the position of judge, defined by Article 69 of the Law of Ukraine " On the Judiciary and the Status of Judges".
    10.2. To be admitted to the Competition the documents and data submitted by the candidates for the position of judge will be checked in order to identify compliance with the requirements for candidates for the position of judge, defined by Article 69 of the Law of Ukraine “On the Judiciary and the Status of Judges”.
    10.3. Information about candidates for the position of judge, admitted to participate in the Competition, is published on the Commission’s official website no later than the next working day after adoption of the Commission’s relevant decision.
    10.4. Admission to the stages of the competition.

    10.4.1. 60 candidates having mentioned their intention to apply for the position of judge of administrative specialization in the application for participation in the competition and occupying a higher position (place) in the ranking of candidates for the position of judge of the local administrative court will be allowed to participate in the formation of the rating of the competition participants for the positions of judges of local administrative courts.

If the position (place) in the rating of the 60th candidate is occupied by two or more candidates having expressed their intention to apply for the position of judge of administrative specialization, all such candidates are admitted to the first stage of the Competition.

    1. 10.4.2. 60 candidates having mentioned their intention to apply for the position of judge of commercial specialization in the application for participation in the competition, occupying a higher position (place) in the ranking of candidates for the position of judge of the local commercial court and not winning any position in the ranking of participants in the competition for the position of judge of the local administrative court will be allowed to participate in the formation of the rating of the competition participants for the positions of judges of local commercial courts.

If the position (place) in the rating of the 60th candidate is occupied by two or more candidates having expressed their intention to apply for the position of judge of commercial specialization, all such candidates are admitted to the second stage of the Competition.

 

    1. 10.4.3. The candidates having mentioned their intention to apply for the position of judge of general specialization in the application for participation in the competition, occupying a higher position (place) in the ranking of candidates for the position of judge of the local general court and not winning any position in the ranking of participants in the competition for the position of judge of the local administrative or commercial court will be allowed to participate in the formation of the rating of the competition participants for the positions of judges of local general courts.
      10.4.4. Information about candidates for the position of judge, admitted to participate in the corresponding stage of the Competition, is published on the Commission’s official website no later than two days before the date of such stage.
      10.4.5. Information about candidates for the position of judge, admitted to participate in the corresponding stage of the Competition on the backup date, is published on the official website of the Commission one day before this backup date.

      10.5. A candidate for the position of a judge, intending to participate in the corresponding stage of the Competition and being admitted to it, is to appear on the date and time of the start of registration determined for them and should have their passport of a citizen of Ukraine.
      10.6. Non-appearance or tardiness of a candidate for the position of judge at the corresponding stage of the Competition for any reason does not prevent the conduct (continuation) of the Competition.
      10.7. A candidate for the position of judge who is late for any reason for the registration of the corresponding stage of the Competition, regardless of their place in the candidates rating for the position of judge of the relevant local court, cannot apply for the position of judge previously replaced by another participant.
      10.8. The rating of the participants of the corresponding stage of the Competition is formed in the following order:
  2.  consecutive invitation by the secretariat of the Commission of participants having registered for the corresponding stage of the Competition, according to the candidates rating for the position of judge of the relevant local court from higher candidate to lower one.

A group of participants occupying the same place in such a rating are invited at the same time.

A participant who is late in registering for the respective stage of the Competition shall be invited by the Commission's secretariat prior to the completion of the ranking of participants on a priority basis if, at the time of registration of such participant, the invitation of participants who are ranked lower in the ranking of candidates for the position of a judge of the respective local court is ongoing;

  1.  selection and announcement by the invited participant of the name of the court in which they intend to fill a vacant position.

In the case of an invitation by the secretariat of the Commission of a group of participants occupying the same place in the candidates rating for the position of a judge of the relevant local court, the participant having scored more points in the practical task of the qualification exam makes their choice primarily, but if the participants score the same number of such points, they make their choice in alphabetical order based on their surnames.

During the selection of a judge position, a participant cannot claim to occupy a vacant judge position, chosen by pre-invited participants with a higher position in the rating (pre-invited group of participants), in the case of taking all vacant judge positions in the court for which the Competition has been announced.

  1.  notification by the secretariat of the Commission of information on the possibility of filling vacant positions of judges in the respective court.

A participant may be denied to apply for a vacant position of a judge only if all vacant positions of judges in the court for which the Competition has been announced are occupied by pre-invited participants (pre-invited group of participants).

Should two or more participants of the relevant group, occupying the same place in the candidates rating for the position of judge of the relevant local court and having the same number of points from the completed practical task of the qualification exam, choose the only or the last vacant position in the court for which the Competition was announced , the question concerning the winner of the competition for the relevant position in the court will be decided by the Higher Qualification Commission of Judges of Ukraine during the approval of the rating of the competition participants by giving preference to the participant having a longer professional experience in the field of law;

  1.  confirmation of the participant’s intention to occupy the relevant position of judge in the protocol of formation of the participants rating of the corresponding stage of the Competition.
    1. 10.8.1. A Competition participant who has confirmed their intention to take up the position of a judge in the protocol for forming the participants rating of the corresponding stage of the Competition cannot change their intention and participate in another stage of the Competition.
      10.8.2. Refusal of the competition participant from choosing and announcing the name of the court in which they intend to fill a vacant position results in termination of their participation in the corresponding stage of the Competition.
      10.9. Should the participants occupy all the judges’ positions for which the corresponding stage of the Competition was announced, the formation of the participants rating is completed.
      10.10.The procedure for forming the participants rating of the corresponding stage of the competition is broadcast on the “Internet” network (on the official YouTube page of the Commission) in real time and is recorded in the protocol for forming the participants rating of the corresponding stage of the Competition.
